Food-Grade Plastic Containers: FDA, EU 10/2011 and Safety Standards Explained

Every year, food businesses buy containers labeled “food-grade” without knowing what that label actually means. The term is heavily regulated in most export markets — but only if you know how to verify it. This guide explains the two dominant food-contact standards (FDA 21 CFR and EU 10/2011), how migration testing works, and how to confirm a container is genuinely food-grade before you buy.

What Makes a Plastic Container Food-Grade?

A plastic container is food-grade when the resin, additives, and manufacturing process comply with food-contact regulations, and when migration testing confirms that no harmful substances transfer into food under real use conditions. Three factors matter:

  • Resin type. Only certain resins are approved for food contact — HDPE, PP, PET, and a handful of others. Resins for industrial use may contain fillers or additives that are not approved.
  • Additives. Colorants, UV stabilizers, and mold-release agents must also be food-contact approved. A container can be “HDPE” yet contain non-food-grade colorants.
  • Manufacturing hygiene. Even approved resin is contaminated if the mold, line, or regrind stream is dirty. Reputable manufacturers run dedicated or fully cleaned lines for food-grade products.

FDA 21 CFR vs EU 10/2011: The Two Big Standards

If you export food containers to the US, the EU, or most other markets, you will encounter one of these two regulatory systems:

  • FDA 21 CFR (US): Lists approved polymers and additives in sections such as 21 CFR 177.1520 (olefin polymers like HDPE/PP). Compliance is the manufacturer’s responsibility; the FDA does not pre-approve containers, but inspections and import checks enforce the rules.
  • EU 10/2011 (Europe): A harmonized framework for plastic food-contact materials. It sets a global migration limit (10 mg/dm² of food contact surface) and specific migration limits (SML) for individual substances. Declaration of Compliance (DoC) documentation is required along the supply chain.
  • Other notable regimes: China GB 4806, Japan’s Food Sanitation Law, and regional GCC standards. Most global brands accept FDA or EU documentation as the baseline.

Migration Testing: How Safety Is Actually Proven

Regulations set limits; testing proves compliance. The key tests are:

  • Overall migration (OM): Total mass of substances transferring into food simulants — must stay under the global limit.
  • Specific migration (SM): Amount of a specific substance (e.g., heavy metals, plasticizers) — each has its own SML.
  • BPA and phthalates: Bisphenol A and phthalate plasticizers are restricted in food-contact plastics; approved alternatives are used instead.
  • Simulant selection: Tests use food simulants (water, 3% acetic acid, 10-50% ethanol, olive oil) chosen to mimic the actual food type, temperature, and contact time.

Ask your supplier for the test report, not just a “food-grade” claim. A genuine report names the simulant, conditions, and result values.

HDPE vs PP for Food Storage

Two resins dominate food-grade containers, and each has a different sweet spot:

  • HDPE (high-density polyethylene): Tough, chemical-resistant, excellent for cold storage, frozen food, transport bins, and heavy-duty totes. Lower temperature resistance than PP — typically safe to ~120°C.
  • PP (polypropylene): Higher heat resistance (~140°C), suitable for hot-fill and dishwasher cycles. Slightly less impact-resistant at low temperatures than HDPE.

For most hotel, catering, and logistics food storage — from food bins to storage containers — HDPE is the workhorse. PP wins where hot fill or repeated dishwasher cycles are involved.

How to Verify a Container Is Food-Grade

  1. Ask for the resin certificate — the material supplier’s data sheet stating food-contact grade.
  2. Ask for a migration test report — from an accredited lab (SGS, TÜV, Intertek) covering your target market’s standard.
  3. Check the Declaration of Compliance (EU) or FDA letter of guaranty — the document chain from resin to finished product.
  4. Look for traceability: batch numbers, date codes, and a manufacturer who can trace each production run to its raw material batch.
  5. Confirm the use conditions — food contact limits depend on temperature and time; a container for frozen storage is not automatically approved for hot fill.
